Terms of use

Draft, pending legal review. Version 0.1, 8 November 2026.

These terms apply to the Damage Analysis app at damage-analysis.com. By creating an account you accept them.

1. Who we are

Damage Analysis is provided by David Stekly, a sole trader in Fairy Meadow, New South Wales, Australia (ABN 13 648 736 212), called "we" in these terms. Contact: hello@dareakt.com.

2. What the service is

  • An app for recording inspections: projects, photos, measurements, markings and reports, with team access for the people you invite.
  • It is a tool. It does not replace the judgement of a qualified inspector, and you check every result before you rely on it.
  • The signed measurement chain shows that a record has not changed since it was signed. It does not show that the measurement itself is right.
  • Naming an inspection procedure on our pages does not mean that the body which wrote it has approved or certified the app.
  • The service is meant for businesses and their inspectors.

3. Price

The service is free today. If we introduce a paid plan, we tell you by email before anything is charged, and nothing is charged unless you choose that plan.

4. Your account

  • Give your real name and email address when you sign up.
  • Keep your sign-in details private. If you think someone else has them, change your password and tell us.
  • You are responsible for what is done in your account and in the organisations you run.

5. Your data

  • The projects, photos and records you put into the app are yours. We use them only to run the service for you.
  • You must have the right to put them into the app, including any personal data of other people they hold.
  • Photo files are not in our backup copies. Keep your own copies of anything you cannot lose.

6. Processing personal data for your organisation

For personal data in your projects and photos, your organisation is the controller and we are its processor (GDPR Article 28). For that processing:

  • We process the data only to run the app and on your instructions. You give instructions by how you use the app, or in writing.
  • Only David Stekly administers our server, and he is bound to keep the data confidential. Section 7 of our privacy notice lists who else handles it.
  • We give you at least 30 days' notice by email of a new or changed provider that handles the data. You may object, and if we cannot agree you may stop using the service with no fee.
  • We protect the data with the measures in section 4 of our privacy notice.
  • We help you answer requests from people to use their rights, and with your duties under GDPR Articles 32 to 36.
  • We tell you without undue delay of a breach of security that affects your data.
  • At the end we hand the data over on request and delete it, unless the law requires us to keep it. Deleting your account does not by itself delete it, so write to us. Backup copies are gone within about 50 days.
  • On request we give you the information you need to show these duties are met. An audit is possible once a year, on at least 30 days' notice, in business hours, at your cost.

7. Availability and our liability

  • We aim to keep the service running, but availability is a target, not a guarantee. There are no service credits.
  • Our total liability is capped at what you paid us in the 12 months before the claim. While the service is free, that is nothing.
  • We are not liable for indirect or consequential loss.
  • Nothing in these terms limits liability that the law does not allow to be limited.

8. Ending

  • You can stop at any time. Write to us to delete your account.
  • We may end the service by giving 30 days' written notice.
  • We may end or suspend it sooner if the service is seriously misused, for example by an attack on it.
  • After the end we hand your data over on request.

9. Changes to these terms

We may change these terms. Each version shows its date and version number at the top and applies from its date. We tell you of a significant change by email at least 30 days before; if you do not agree, you can stop using the service.

10. Governing law

These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales decide disputes. Nothing in them removes rights you have as a consumer under the law of your own country.
